US District Court Judge Glenn Suddaby <a href=\"https:\/\/www.reuters.com\/legal\/federal-judge-suspends-many-new-yorks-new-gun-restrictions-2022-11-07\/\" target=\"_blank\" rel=\"noopener\">issued an injunction<\/a> blocking major portions of the law including the subjective \u201cgood moral character\u201d requirement, the mandate that applicants provide the names and contact information of other adults in the home, and the requirement for social media account information.<\/p>\n<p>He also blocked enforcement of bans on carry in \u201csensitive location\u201d like healthcare facilities, houses of worship, theaters, bars, public transportation and airports.<\/p>\n<p>Significantly, Judge Suddaby also blocked enforcement of the parts of the law that make it a felony to possess a gun on private property without the owner\u2019s express permission. That feature of the law converted most of the state into <em>de facto<\/em> no-go zones for those carrying firearms. Suddaby left carry bans in place for schools, courthouses, and polling places.<\/p>\n<p>The judge denied the state\u2019s request for a stay of his injunction pending appeal. You can read his ruling <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nynd.134829\/gov.uscourts.nynd.134829.78.0_1.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>Here\u2019s GOA\u2019s press release . . .<\/p>\n<p style=\"padding-left: 40px;\"><em>Gun Owners of America and Gun Owners Foundation secured a <a href=\"https:\/\/link.mediaoutreach.meltwater.com\/ls\/click?upn=8K5Wri0pbLgOz7Ya1AR-2BtIRgQl1MEjMLQs1QinsaojNKxlkQ31OLx7nBgS1HgrL0AS88-2Fzs6n2sqsFnne-2FNBsMP9I-2FGLc0W51QVNnBizAfSaDZNr4dRERlZVrKDD-2B3t4JAjDaMiwbRqBVOlhfAEHL4gcIah6AIBKGmHpDfpmzNQ-3DDez8_ZAJHq58it0YdgsvWrf44jWabR-2BpFNrZa57y3nHcLqX56tVnvl1pDPc0VGA-2B9JOSo9-2Bv0TcnS7kYR9bcVo98L8lJ8A8zLDOj04ZRBtaG-2FoIIJmu3I8al4-2Badp-2FL0rTq53FD771gq32opkaDej2r7KEJ2A9K0KECJINgZEX5YPNInZStjhzlO2CedTFGszCKKGvuxxVADZmOl-2Bpn0T9OjhRIfviQATrcz53YhfAtTg6QW5laj2z613Q9luuTpCZnJLb49oNtDrojxpjARWEgBpn1lA1-2B5SjhUEmtV1onEJ24GjodsdKByksJ-2Bv-2BpO2RhPOYZf9Hl9-2FugG-2FSr2SnzcjinRO9qK1ToskIPRddEHSD8YGviBvAaGSJQOfFpJ78V1rlQ3WT5YdsJFgUr-2FLrVCdbw-3D-3D\" target=\"_blank\" rel=\"noopener\">preliminary injunction in federal district court<\/a> against most of New York\u2019s poorly named \u201cConcealed Carry Improvement Act.\u201d This follows GOA and GOF securing a <a href=\"https:\/\/link.mediaoutreach.meltwater.com\/ls\/click?upn=8K5Wri0pbLgOz7Ya1AR-2BtIRgQl1MEjMLQs1QinsaojPh-2Fe-2B01qpMxIF4W3dAG-2FkKsi-2F5yZiVIcvRZB665zu-2BPW2igW5xChy5rgWk4EeRn6NeZGWYDFp3ewcHlkxScmYaivte0hr11fd-2FlekbPj0g062gvVALnY-2FqFj3TXApAJe4mqJzIOGWF9GDlwyfY8tA3U7ao_ZAJHq58it0YdgsvWrf44jWabR-2BpFNrZa57y3nHcLqX56tVnvl1pDPc0VGA-2B9JOSo9-2Bv0TcnS7kYR9bcVo98L8lJ8A8zLDOj04ZRBtaG-2FoIIJmu3I8al4-2Badp-2FL0rTq53FD771gq32opkaDej2r7KEJ2A9K0KECJINgZEX5YPNInZStjhzlO2CedTFGszCKKGvuxxVADZmOl-2Bpn0T9OjhRIfviQATrcz53YhfAtTg6QUcq7MuV9JITgUNW6eawCEfCLqh12fAdVYvLoexLZW3vg40nW-2F-2FYbpu6xCLtoqcLRcNWhPReqaSFkXvLwypTy5-2Bft18ZSTfGYxs0fHJHCZ-2BO9-2FvXXZOphgm1YTt-2Fx6cRtOURh5o7tb0hCCF44fKem9BnZzuoAYd56w3h6v61UZtQA-3D-3D\" target=\"_blank\" rel=\"noopener\">temporary restraining order<\/a> against the law in October, which was frustratingly blocked by a federal appeals court.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The ruling from Judge Glenn Suddaby, who indicated this law has imposed \u201cunprecedented constitutional violations,\u201c enjoins the following provisions:<\/em><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><em>Requiring good moral character<\/em><\/li>\n<li><em>Requiring the names and contact info of spouses and other adults in the applicant\u2019s home<\/em><\/li>\n<li><em>Requiring applicants to disclose social media accounts for review<\/em><\/li>\n<li><em>The restrictions on carrying in public parks, zoos, places of worship, locations where alcohol is served, theaters, banquet halls, conferences, airports and buses, lawful protests or assemblies, and the prohibition on carrying on private property without express consent from the owner<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><em>The injunction will take effect immediately, despite the State of New York\u2019s attempt to delay the injunction.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><strong>Erich Pratt, GOA\u2019s Senior Vice President, issued the following statement:<\/strong><\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cJust like we warned politicians after the Bruen decision, fall in line, or we will force you to. We are excited to see Kathy Hochul finally served a plate of humble pie, and we are fully prepared to continue the fight should she again attempt to disarm the citizens of her state at a time when her party\u2019s policies are only escalating the danger that everyday citizens face.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><strong>Sam Paredes, on behalf of the Board of Directors for the Gun Owners Foundation, added:<\/strong><\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cThis is very exciting for the citizens of New York, as today liberty won and tyranny lost.
