{"id":4863,"date":"2025-04-06T03:18:51","date_gmt":"2025-04-06T03:18:51","guid":{"rendered":"https:\/\/gunsandpride.com\/?p=4863"},"modified":"2025-04-06T03:18:51","modified_gmt":"2025-04-06T03:18:51","slug":"navy-vet-jailed-over-atf-lies-and-toy-guns","status":"publish","type":"post","link":"https:\/\/gunsandpride.com\/?p=4863","title":{"rendered":"Navy Vet Jailed Over ATF Lies and Toy Guns"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>by Lee Williams<\/p>\n<p>It now appears that the only way former American sailor, Patrick \u201cTate\u201d Adamiak, may get out of his undeserved 20-year prison sentence is through a presidential pardon, because federal prosecutors are now using the lies and fake evidence created by the ATF to fight an appeal filed by the 31-year-old former Navy E-6, who had just been accepted by Naval Special Warfare before his arrest.\u00a0<\/p>\n<p>Adamiak has been in federal prison for almost 30 months. It can take up to half of a year for his court hearings.\u00a0\u00a0<\/p>\n<p>In a letter to prosecutors sent Feb. 14, Adamiak\u2019s appellant attorney pointed out that his client never possessed anything illegal. Prosecutors, unfortunately, don\u2019t seem to care.\u00a0<\/p>\n<p>Matthew Larosiere, Esq., Counsel for Appellant Adamiak, cited <em>United States v. Justin Bryce Brown<\/em>, in a letter sent to the Clerk of the U.S. Court of Appeals for the Fourth Circuit.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe argument found to be lacking in <em>Brown<\/em> is in all material respects identical to the argument brought by the government below in opposing Appellant\u2019s motion to dismiss,\u201d Larosiere wrote. \u201cAppellant feels it important to note the items charged in Brown were functional machineguns, as opposed to the non-functional items charged here.\u201d<\/p>\n<\/blockquote>\n<p>In other words, Adamiak had gun parts but not any illegal firearms, and he certainly had no machineguns.\u00a0<\/p>\n<p>But in a response mailed five days later, Assistant United States Attorney Jacqueline R. Bechara continued the prosecution\u2019s the-guns-are-real tactic.\u00a0\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cBecause Adamiak\u2019s possession of an unregistered machinegun fell outside the scope of the Second Amendment, the district court properly denied his motion to dismiss,\u201d Bechara said in her response.\u00a0<\/p>\n<\/blockquote>\n<p>In a second letter to the Clerk of Court sent March 28, Bechara describes Adamiak\u2019s firearms even further, although she is completely wrong.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cHere, the evidence at trial established that the PPSh-41 is a \u2018machinegun\u2019 because it is a \u2018weapon\u2019 which \u2018is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger,\u2019 and that the grenade launchers and anti-tank missile launchers were \u2018destructive device[s],\u2019 because they were \u2018weapons, which will, or which may be readily converted to, expel a projectile by the action of an explosive,\u2019\u201d Bechara wrote.\u00a0<\/p>\n<\/blockquote>\n<p>AUSA Bechara declined to be interviewed for this story, but there are a few things to keep in mind regarding her latest legal claim. Every single PPSh-41 that Adamiak owned had its receiver cut in half. There was no way any of the gun parts kits he owned would shoot \u201cautomatically more than one shot, without manual reloading, by a single function of the trigger.\u201d<\/p>\n<p><strong>ATF\u2019s lies\u00a0\u00a0\u00a0<\/strong><\/p>\n<p>After their informant lied and dozens of heavily armed ATF agents kicked open Adamiak\u2019s door during a search warrant, nothing illegal was found. As a result, the ATF was forced to call in their ringer, <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2025\/02\/ATF-Tech-Report-2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Firearms Enforcement Officer Jeffrey Bodell.<\/a><\/p>\n<p>Once the ATF turned the case over to Bodell, Adamiak\u2019s innocence no longer mattered. Bodell would break the rules. He actually turned toys into firearms, legal RPGs into destructive devices and 100% legal semi-autos into machineguns.<\/p>\n<ul class=\"wp-block-list\">\n<li>Bodell inserted a real STEN action and a real STEN barrel into Adamiak\u2019s toy STEN submachinegun and got it to fire one round, even though the toy\u2019s receiver wouldn\u2019t accept a real STEN magazine. Bodell actually classified the toy, which are very popular, as a machinegun. The toy STENs are still completely legal and widely sold.<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>Bodell test fired five of Adamiak\u2019s very expensive and extremely collectible legal semi-autos, which fire from an open bolt. All the ATF technician could achieve was semi-auto fire, but that didn\u2019t stop him. He classified all five highly sought after pistols as machineguns. These semi-autos are still legal, very collectible and widely sold. Today, one can fetch from $3,000 to $5,000, and they can still be purchased just like any other firearm, with only an ATF Form 4473 and background check.<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>Bodell ruled that several receivers that had been cut in half were actually machineguns. The same parts are still legally sold online and do not even require any paperwork.<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>Bodell actually rebuilt three of Adamiak\u2019s inert RPGs, which had holes drilled into their receivers and were stripped of internal parts. Bodell added parts from ATF\u2019s real RPGs until they would fire a single subcaliber 7.62x39mm round. As a result, he classified the RPGs as destructive devices, even though to this day they\u2019re completely legal and widely sold.<\/li>\n<\/ul>\n<p>Bodell\u2019s lies were legion.\u00a0<\/p>\n<p><a href=\"https:\/\/thegunwriter.substack.com\/p\/sailor-serving-20-years-in-prison?utm_source=publication-search\" target=\"_blank\" rel=\"noreferrer noopener\">He actually turned toys into firearms, legal RPGs into destructive devices and 100% legal semi-autos into machineguns.<\/a> All of what Bodell insisted were illegal items are still sold legally online:\u00a0<a href=\"https:\/\/www.gunbroker.com\/item\/1094511481\" target=\"_blank\" rel=\"noreferrer noopener\">Inert RPGs<\/a>,\u00a0<a href=\"https:\/\/www.ebay.com\/sch\/i.html?_nkw=sten+gun&amp;_sop=12&amp;msockid=13c1045068aa66b8353b0bac690d6794\" target=\"_blank\" rel=\"noreferrer noopener\">toy STENs<\/a>,\u00a0<a href=\"https:\/\/www.gunbroker.com\/item\/1087983539\" target=\"_blank\" rel=\"noreferrer noopener\">submachinegun receivers<\/a>\u00a0and especially\u00a0<a href=\"https:\/\/www.gunbroker.com\/item\/1094610112\" target=\"_blank\" rel=\"noreferrer noopener\">open-bolt semi-autos<\/a>.\u00a0<\/p>\n<p>The RPGs, toy STENs and submachinegun receivers don\u2019t require any paperwork to purchase.<\/p>\n<p><strong>Adamiak\u2019s plight\u00a0<\/strong><\/p>\n<p>Adamiak committed no crime, so why is he still serving a 20-year sentence at a federal prison in New Jersey?\u00a0<\/p>\n<p>Because the ATF screwed up, and they would rather charge an innocent man, kill his elite military career and force him to serve two decades behind bars than admit the truth\u2014that their special agents don\u2019t have a clue about what they\u2019re doing.<\/p>\n<p>Bodell\u2019s alleged \u201cresearch\u201d would be hilarious \u2013 especially his turning a toy STEN into a machinegun \u2013 if Adamiak wasn\u2019t serving 20 years behind bars as a result.\u00a0<\/p>\n<p>Adamiak\u2019s appeal is on hold for legal reasons. Therefore, the quickest way he could walk out of prison as a free man would be a presidential pardon.\u00a0<\/p>\n<p>If President Donald Trump needs to know what kind of a man he\u2019d be pardoning, Adamiak would be the perfect choice. All he wants is to return to the Navy and resume his career. He\u2019s honest, selfless and dedicated to serving this great country. That should be all President Trump needs to know.\u00a0<\/p>\n<p>A couple of crazed ATF agents, overzealous prosecutors and an anti-gun judge took everything from this young man \u2013 his freedom, his reputation and all of his hard-earned possessions. However, Adamiak is willing to forget and forgive and go back to work keeping us safe. All he needs is the opportunity.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>In a brief interview Monday, Adamiak said: \u201cI just want my life back. I want to go back to what I dedicated my life to, which was serving the country. I want to return to my career in the Navy despite all that has happened to me.
