Bonta Case"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"td-post-featured-image\">\n<figure><a href=\"https:\/\/cdn0.thetruthaboutguns.com\/wp-content\/uploads\/2021\/03\/Boch-Ammo-higher-res.jpg\" data-caption=\"John Boch Image\" data-wpel-link=\"internal\"><\/a><figcaption class=\"wp-caption-text\">John Boch Image<\/figcaption><\/figure>\n<\/div>\n<p>The ongoing legal battle over California\u2019s strict ammunition purchase and transportation laws reached a critical milestone this week as the Ninth Circuit Court of Appeals in Pasadena heard oral arguments in\u00a0<em><a href=\"https:\/\/www.ca9.uscourts.gov\/cases-of-interest\/rhode-v-bonta\/\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Rhode v. Bonta<\/a><\/em>, Dec. 4. The case challenges provisions of California\u2019s Proposition 63, which imposes some of the nation\u2019s most restrictive regulations on ammunition buyers.<\/p>\n<p>The case, originally filed by the <a href=\"https:\/\/crpa.org\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">California Rifle &amp; Pistol Association<\/a> (CRPA) and lead plaintiff, Olympic champion Kim Rhode, gained momentum earlier this year when U.S. District Judge Roger Benitez <a href=\"https:\/\/www.thetruthaboutguns.com\/court-rules-ca-ammo-background-checks-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">ruled the law unconstitutiona<\/a>l. However, the Ninth Circuit promptly <a href=\"https:\/\/www.thetruthaboutguns.com\/ammo-background-checks-back-on-in-peoples-republic-of-california\/\" data-wpel-link=\"internal\">stayed the decision<\/a> following the state\u2019s appeal, keeping the regulations in place while the case proceeds.<\/p>\n<h2 class=\"wp-block-heading\">An Unprecedented Law<\/h2>\n<p>Attorneys representing the plaintiffs argued that California\u2019s restrictions on ammunition purchases are unprecedented, noting that such laws have no historical equivalent as required by the Supreme Court\u2019s\u00a0<em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">Bruen<\/a><\/em>\u00a0decision. That ruling established the necessity for modern firearms regulations to align with historical traditions of the Second Amendment.<\/p>\n<p>\u201cNot once in this country\u2019s history has the government required background checks for securing ammunition under a scheme as restrictive as California\u2019s,\u201d CRPA attorneys emphasized, pointing out that the state\u2019s approach lacks a historical analog.<\/p>\n<p>CRPA President &amp; General Counsel Chuck Michel reiterated the importance of today\u2019s hearing:<\/p>\n<p><em>\u201cThe Supreme Court remanded this case back to the Ninth Circuit so that it could follow the directive laid out in Bruen. Our arguments today forcefully demonstrate that ammunition is, of course, covered by the Second Amendment and that the restrictions put in place by the state simply don\u2019t hold up to the standard established in Bruen.\u201d<\/em><\/p>\n<h2 class=\"wp-block-heading nitro-lazy\">Broad Support<\/h2>\n<p>The case has garnered support from numerous Second Amendment organizations, including <a href=\"https:\/\/gunownersca.com\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Gun Owners of California<\/a>, <a href=\"https:\/\/www.gunowners.org\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Gun Owners of America<\/a>, the <a href=\"https:\/\/foundation.gunowners.org\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Gun Owners Foundation<\/a> and the <a href=\"https:\/\/home.nra.org\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">National Rifle Association<\/a>. Several <a href=\"https:\/\/michellawyers.com\/wp-content\/uploads\/2024\/07\/2024-07-31-Amicus-Brief-of-States-ISO-Appellees-Plaintiffs.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">amicus briefs<\/a> have been filed, including from 24 states and major ammunition retailers like Able\u2019s Sporting Goods, Ammunition Depot and Sam\u2019s Shooters Emporium.<\/p>\n<h2 class=\"wp-block-heading\">Eight Years of Legal Struggle<\/h2>\n<p>Proposition 63, passed in 2016, introduced requirements such as background checks for ammunition purchases, prohibitions on bringing lawfully purchased ammunition across state lines and additional restrictions deemed burdensome by critics. Over the past eight years, CRPA and its allies have worked tirelessly to challenge the law, citing its infringement on fundamental Second Amendment rights.<\/p>\n<h3 class=\"wp-block-heading\"><strong>Call to Action<\/strong><\/h3>\n<p>As the case progresses, CRPA is urging supporters to remain vigilant and <a href=\"https:\/\/donorbox.org\/rhodevbonta\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">support the organization<\/a> in its fight.<\/p>\n<p>The Ninth Circuit\u2019s decision in\u00a0<em>Rhode v.
