{"id":4221,"date":"2024-11-24T06:47:05","date_gmt":"2024-11-24T06:47:05","guid":{"rendered":"https:\/\/gunsandpride.com\/?p=4221"},"modified":"2024-11-24T06:47:05","modified_gmt":"2024-11-24T06:47:05","slug":"hawaii-gun-control-laws-targeting-young-adults-challenged","status":"publish","type":"post","link":"https:\/\/gunsandpride.com\/?p=4221","title":{"rendered":"Hawaii Gun Control Laws Targeting Young Adults Challenged"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"td-post-featured-image\"><a href=\"https:\/\/cdn0.thetruthaboutguns.com\/wp-content\/uploads\/2024\/11\/Hawaii-Waikiki-Beach_Shutterstock.jpg\" data-caption=\"\" data-wpel-link=\"internal\"><\/a><\/div>\n<p>The <a href=\"http:\/\/www.saf.org\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">SAF <\/a>has filed a federal lawsuit against the state of Hawaii, challenging gun control laws that prohibit young adults between the ages of 18 and 20 from purchasing or possessing firearms and ammunition.<\/p>\n<p>The <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2024\/11\/Pinales-v.-Lopez-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">lawsuit<\/a>, filed Tuesday in the U.S. District Court for the District of Hawaii, argues that these restrictions violate the plaintiffs\u2019 Second and Fourteenth Amendment rights. SAF is joined in the legal action by Aloha Strategics LLC, JGB Arms LLC and two private citizens, Juda Roache and Elijah Pinales. The case is titled\u00a0<em>Pinales v. Attorney General for the State of Hawaii<\/em>.<\/p>\n<p>Named as the defendant in the suit is Hawaii Attorney General Anne E. Lopez, in her official capacity.<\/p>\n<p>The plaintiffs are seeking injunctive relief, which would temporarily block the enforcement of the state\u2019s gun restrictions while the case is pending. Attorneys Kevin O\u2019Grady of Honolulu and Alan Beck of San Diego are representing the plaintiffs.<\/p>\n<p>\u201cHawaii\u2019s ban on the purchase and possession of firearms by adults in the 18-to-20-year-old age group makes it impossible for these citizens to exercise their constitutional right to keep and bear arms,\u201d said SAF Executive Director Adam Kraut. \u201cTheir rights have been affirmed by recent Supreme Court rulings, and Hawaii\u2019s statutes clearly conflict with those decisions.\u201d<\/p>\n<p>SAF founder Alan M. Gottlieb criticized Hawaii\u2019s laws as an infringement on constitutional rights. \u201cHawaii has essentially decided the Second Amendment doesn\u2019t apply in that state, and they can\u2019t be allowed to get away with it,\u201d he said. \u201cUnder the Fourteenth Amendment, no state shall make or enforce any law which abridges the rights guaranteed to citizens by the U.S. Constitution, and that includes young adults.\u201d<\/p>\n<p>The lawsuit comes on the heels of the U.S. Supreme Court\u2019s 2022 ruling in\u00a0<em>New York State Rifle &amp; Pistol Association v. Bruen<\/em>, which clarified that gun control laws must align with the nation\u2019s historical tradition of gun regulation.<\/p>\n<p>In addition to the federal complaint, SAF attorneys have filed a <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2024\/11\/Pinales-MPI-Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">memorandum in support<\/a> of a motion for a preliminary injunction to prevent the enforcement of Hawaii\u2019s gun restrictions while the case moves forward.<\/p>\n<p>The lawsuit is the latest in a series of legal challenges aimed at revising state-level gun laws that plaintiffs believe infringe upon Second Amendment rights.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.thetruthaboutguns.com\/hawaii-gun-control-laws-targeting-young-adults-challenged\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The SAF has filed a federal lawsuit against the state of Hawaii, challenging gun control laws that prohibit young adults between the ages of 18 and 20 from purchasing or possessing firearms and ammunition.
