{"id":4063,"date":"2024-10-23T13:04:27","date_gmt":"2024-10-23T13:04:27","guid":{"rendered":"https:\/\/gunsandpride.com\/?p=4063"},"modified":"2024-10-23T13:04:27","modified_gmt":"2024-10-23T13:04:27","slug":"crpa-files-brief-in-nonresident-carry-lawsuit","status":"publish","type":"post","link":"https:\/\/gunsandpride.com\/?p=4063","title":{"rendered":"CRPA Files Brief In Nonresident Carry Lawsuit"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"td-post-featured-image\"><a href=\"https:\/\/cdn0.thetruthaboutguns.com\/wp-content\/uploads\/2024\/10\/Screen-Shot-2024-10-20-at-1.04.29-PM.png\" data-caption=\"\" data-wpel-link=\"internal\"><\/a><\/div>\n<p>With California gun owners <a href=\"https:\/\/www.thetruthaboutguns.com\/the-nickel-and-diming-of-gun-owners-in-california\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">under constant siege<\/a> by Democrats passing more restrictive firearms laws on a regular basis, one organization is actively battling throughout the state to help ensure Californians\u2019 right to keep and bear arms isn\u2019t infringed.<\/p>\n<p>Since the critical 2022 U.S. Supreme Court decision in <em>New York State Rifle &amp; Pistol Association v. Bruen<\/em>, the California Rifle &amp; Pistol Association has worked in every county in the state to ensure a concealed carry application and issuance process that complies with the standards set out in the <em>Bruen <\/em>ruling.<\/p>\n<p>\u201cIn most cases, our efforts focus on unnecessary delays and outrageous fees, but recently CRPA and our allies filed an amicus brief in Matthews v. City of Los Angeles, supporting \u00a0the challenge to the state\u2019sban on out-of-state residents obtaining CCWs,\u201d CRPA said in <a href=\"https:\/\/crpa.org\/news\/blogs\/crpa-files-amicus-brief-fighting-for-ccws\/\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">a recent news item<\/a>.\u00a0\u201cThe brief argues that there is no historical basis for requiring a CCW from another state when traveling. In fact, historical evidence suggests the opposite: Many laws specifically protected the right to self-defense regardless of one\u2019s location.\u201d<\/p>\n<p>In the <a href=\"https:\/\/crpa.org\/wp-content\/uploads\/2024\/10\/Matthews-v-City-of-LA-Amicus-Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">recently filed brief<\/a>, plaintiffs argue that the case isn\u2019t a difficult one, given <em>Bruen<\/em>\u2019s requirement to prove a historical precedent.<\/p>\n<p>\u201cThis case is simple,\u201d the brief stated. \u201cNo historical tradition supports California\u2019s modern requirement that peaceable nonresidents\u2014who are already permitted to carry firearms in their home states\u2014submit to a burdensome process to obtain a California license to carry (\u2018CCW permit\u2019) if they wish to exercise their Second Amendment rights while visiting or passing through the state. On the contrary, laws historically exempted travelers from such local restrictions on their right to defend themselves while traveling. Americans of earlier eras knew that requiring citizens visiting another state to give up the right to bear arms was untenable.\u201d<\/p>\n<p>Concerning plaintiff Garry Matthews, the brief pointed out that Los Angeles County had a long history of issuing very few carry permits, even to residents.<\/p>\n<p>\u201cWhile Mr. Matthews was barred from receiving a permit de jure, he was also, like the other two Appellants, Messrs. Hunn and Hearns, barred from doing so de facto,\u201d the brief stated. \u201cEven if he had established residency in California, he still would not have gotten a CCW permit from Appellees. Before <em>Bruen<\/em>, LAPD did not issue CCW permits to almost anyone\u2014whether residents or not. In fact, then-Chief Michel Moore had even moved to cancel the few remaining permits still in civilian hands. Before 2022, there were only four active CCW permits issued by LAPD in Los Angeles, despite the city having a large population of 3.8 million people.\u201d<\/p>\n<p>As the CRPA news release pointed out, the law creates an \u201cimpossible\u201d situation for nonresidents wanting to comply with California\u2019s regulations but not able to do so.<\/p>\n<p>\u201cEven if such a requirement were valid, California\u2019s law creates an impossible situation,\u201d CRPA stated. \u201cOut-of-state residents are prohibited from even obtaining a CCW in California, leaving them in a state of legal limbo.
