Kathy Hochul (AP Photo\/Joshua Bessex)<\/figcaption><\/figure>\n<\/div>\n<p>Leaning heavily on the second <em>Bruen<\/em> standard\u2014the ability to show a historical precedent\u2014a district court in New York on Thursday permanently enjoined the state\u2019s law banning guns on private property open to the public without express consent of the owner.<\/p>\n<p>In the case <em>Christian v. James<\/em>, U.S. District Judge John. L. Sinatra of the U.S. District Court for the Western District of New York wrote in the ruling that the state\u2019s arguments concerning past \u201csimilar\u201d laws weren\u2019t convincing enough.<\/p>\n<p>\u201cRegulation in this area is permissible\u00a0<em>only if<\/em>\u00a0the government demonstrates that the new enactment is consistent with the Nation\u2019s historical tradition of sufficiently analogous regulations,\u201d the court stated in the ruling. \u201cIndeed, property owners have the right to exclude. But\u00a0<em>the state<\/em>\u00a0may not unilaterally exercise that right and, thereby, interfere with the long-established Second Amendment rights of law-abiding citizens who seek to carry for self-defense on private property open to the public.\u201d<\/p>\n<p>Just the day before the ruling, New York Gov. Kathy Hochul had gloated that, after the Supreme Court\u2019s\u00a0<em>Bruen\u00a0<\/em>decision, the state \u201cdoubled down\u201d on its anti-rights agenda. \u201c[The State] came up with legislation,\u201d Hochul said in a news release. \u201cAnd we have a prohibition on concealed carry weapons in sensitive places. I personally think every place is sensitive.\u201d\u00a0<\/p>\n<p>However, the court disagreed and handed Hochul yet another loss on a law that infringes upon New Yorkers\u2019 Second Amendment rights. That fact wasn\u2019t lost on Brandon Combs, president of the Firearms Policy Coalition (FPC), which brought the lawsuit.<\/p>\n<p>\u201cThis is yet another important victory for Second Amendment rights and another major loss for New York, authoritarian governments, and radical anti-rights organizations like Everytown and Giffords,\u201d Combs said in an FPC press release. \u201cWe will continue to fight forward as we work to restore the full scope of the right to keep and bear arms throughout the United States. Hopefully Kathy Hochul is ready to write another check for legal fees.\u201d<\/p>\n<p>The ruling further stated: \u201cIn sum, none of the proffered Founding-era enactments, fairly read, burdened the individual\u2019s right to carry firearms in the same way, to the same extent, or for the same reasons as the restrictions here\u2014which impose a default rule banning firearms on <em>all<\/em> private property open to the public for \u2018whatever reason and regardless of the nature of the land at issue.\u2019\u201d<\/p>\n<p>In the end, the court ruled that, effective immediately, the state could longer enforce the provision.<\/p>\n<p>\u201cIt is \u2026 ordered that defendant\u2019s and their officers, agents, servants, employees and all persons in concert or in participation with them who receive notice of this order are permanently enjoined, effective immediately, from enforcing [the law] with respect to private property open to the public, and their regulations, policies and practices implementing it,\u201d the ruling concluded.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.thetruthaboutguns.com\/court-blocks-enforcement-of-ny-carry-ban-on-private-property-open-to-the-public\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>New York Gov.
