It\u2019s been particularly rough going in the Empire State. After ramming through punitively restrictive laws limiting concealed carry following the <em>Bruen<\/em> decision, Governor Kathy Hochul\u2019s legislative temper tantrum (AKA, the <a href=\"https:\/\/www.governor.ny.gov\/news\/statement-governor-hochul-concealed-carry-improvement-act\" target=\"_blank\" rel=\"noopener\">Concealed Carry Improvement Act<\/a>) has taken some serious hits.<\/p>\n<p>Last week, a judge granted an application for a temporary restraining order blocking enforcement of the based on the likelihood that many parts of the law including the ban on carry in \u201csensitive places\u201d are <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-new-york-social-media-gun-politics-d2682ad7dc21aacac49b247e2a3cd518\" target=\"_blank\" rel=\"noopener\">unconstitutional<\/a>. He agreed to keep the law <a href=\"https:\/\/www.cnn.com\/2022\/10\/12\/politics\/new-york-gun-laws\/index.html\" target=\"_blank\" rel=\"noopener\">in place<\/a>, however, while the state appeals the ruling.<\/p>\n<p>Now the Second Amendment Foundation has filed suit challenging the law\u2019s ban on carry in churches. This is in addition to <a href=\"https:\/\/nypost.com\/2022\/10\/08\/orthodox-jews-suing-over-ny-gun-law-restrictions-for-synagogues\/\" target=\"_blank\" rel=\"noopener\">a similar challenge<\/a> last week from a Brooklyn congregation seeking the right to carry in synagogues. Here\u2019s the SAF\u2019s press release . . .<\/p>\n<p style=\"padding-left: 40px;\"><em>The Second Amendment Foundation today <a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2022\/10\/Complaint-with-exhibit-Cover-Sheet-C-C.pdf\">filed suit in federal court<\/a> challenging the new concealed carry statute in New York State that, among other things, prohibits concealed carry in churches.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Joining SAF in this legal action are the Firearms Policy Coalition, Inc. and two private citizens, Bishop Larry A. Boyd of Buffalo and Rev. Dr. Jimmie Hardaway, Jr., of Niagara Falls. The lawsuit was filed in U.S. District Court for the Western District of New York.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Defendants are State Police Supt. Kevin P. Bruen, Niagara County District Attorney Brian D. Seaman, and Erie County District Attorney John J. Flynn, all in their official capacities. The case is known as Hardaway v. Bruen.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The 23-page federal complaint says Hardaway and Boyd \u201care leaders of their respective churches, who wish to exercise their fundamental, individual right to bear arms in public for self-defense\u201d and for the safety of their congregants, but are prohibited from doing so because the state law prevents them from doing so.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cHere is yet another example of the sweeping irrationality of New York\u2019s hastily-slapped-together law, which was obviously written to allow the state to dance around the U.S. Supreme Court\u2019s ruling in New York State Rifle &amp; Pistol Association v. Bruen,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb. \u201cOne would think by now the state would have wised up and changed its law to comply with not only the letter of the high court ruling, but the spirit in which the decision was written.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cInstead,\u201d he continued, \u201cNew York officials are determined to fight progress, not to mention the Supreme Court\u2019s common sense, by engaging in legal acrobatics that promise to mire the state in federal lawsuits for the foreseeable future. The right of self-defense is the oldest human right, and New York\u2019s law is written to frustrate the exercise of that right at every turn.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Plaintiffs are represented by attorneys David H.
