Raoul<\/em>, one of several challenges to Illinois\u2019 bans on Modern Sporting Rifles (MSRs) and standard-capacity magazines. The decision not to review the <strong><a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2024\/07\/USCirApp7thCirDecisionReBarnettvRaoul-RevdPI11-04-23.pdf\" target=\"_blank\" rel=\"noopener\">U.S. Court of Appeals for the Seventh Circuit\u2019s decision<\/a><\/strong> at this early stage of the litigation, while disappointing, does not mean the Supreme Court will not review the matter later after final judgment.<\/p>\n<p>The Supreme Court denied review now because the U.S. Court of Appeals has not yet issued a final judgment. Justice Samuel Alito, however, would have granted the petition now. Justice Clarence Thomas <strong><a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2024\/07\/BarnettvRaoul-JusticeThomasOpinionConcurringinDenialofCert-07-02-24.pdf\" target=\"_blank\" rel=\"noopener\" data-outlook-id=\"c745d28a-2a00-4d16-a75e-1af682afa7c1\">wrote<\/a>,<\/strong> \u201cThis Court is rightly wary of taking cases in an interlocutory posture. But, I hope we will consider the important issue presented by these petitions after the cases reach final judgment.\u201d<\/p>\n<p>Justice Thomas concluded Illinois\u2019 bans are \u201chighly suspect,\u201d finding it \u201cdifficult to see how the Seventh Circuit could have concluded that the most widely owned semiautomatic rifles are not \u2018Arms\u2019 protected by the Second Amendment.\u201d He <strong><a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2024\/07\/BarnettvRaoul-JusticeThomasOpinionConcurringinDenialofCert-07-02-24.pdf\" target=\"_blank\" rel=\"noopener\" data-outlook-id=\"0bb61caa-5db7-4fef-a6e8-7ea95eccedee\">added<\/a>,<\/strong> \u201cBut, if the Seventh Circuit ultimately allows Illinois to ban America\u2019s most common civilian rifle, we can\u2014and should\u2014review that decision once the cases reach a final judgment. The Court must not permit \u2018the Seventh Circuit [to] relegat[e] the Second Amendment to a second-class right.\u2019\u201d<\/p>\n<p>\u201cWe are disappointed the U.S. Supreme Court chose not to accept this challenge at this time to what is clearly an unconstitutional law,\u201d said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. \u201cThe Modern Sporting Rifle \u2013 or AR-15-style rifle \u2013 is the most popular-selling centerfire rifle in America, used for lawful purposes every day. That includes recreational target shooting, hunting and self-defense. These rifles are clearly \u2018Arms\u2019 that are protected by the Second Amendment for law-abiding citizens to keep and bear.\u201d<\/p>\n<p>There are over <a href=\"https:\/\/www.nssf.org\/articles\/nssf-releases-most-recent-firearm-production-figures-2024\/\" target=\"_blank\" rel=\"noopener\" data-outlook-id=\"6ce94f94-69e5-482a-8540-b8e2f5caab74\"><strong>28.1 million MSRs<\/strong><\/a> in circulation today, more than there are Ford F-150s on the road today \u2013 the most popular-selling pick-up truck in America.<\/p>\n<p>The challenge to Illinois\u2019 ban on MSRs and standard-capacity magazines, <em>Barnett v.
