Cook County<\/a><\/em>, the Firearms Policy Coalition has filed a court brief detailing why the ban on so-called \u201cassault weapons\u201d runs afoul of the Second Amendment and is, therefore, unconstitutional.<\/p>\n<p>The <a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6277\/attachments\/original\/1719324964\/2024.06.24_14_Brief_of_Plaintiffs-Appellants_%28FPC%29.pdf?1719324964\">brief<\/a>, filed on Tuesday, is direct and to the point, presenting a convincing argument.<\/p>\n<p>\u201cThe question presented by this case is whether the Second Amendment permits the government to ban the best-selling rifle in America and similar semiautomatic firearms,\u201d the FPC\u00a0 brief states. \u201cThe answer is no. In <em>District of Columbia v. Heller<\/em>, the Supreme Court held that \u2018[t]he 18<sup>th<\/sup> century meaning\u2019 of the word \u2018arms\u2019 is \u2018no different from the meaning today\u2019\u2014namely, \u2018weapons of offense, or armor or defense.\u2019 And because the plain text of the Second Amendment does not distinguish between types of bearable arms, the Amendment\u2019s protection \u2018extends, prima facie, to all instruments that constitute bearable arms.\u2019\u201d<\/p>\n<p>The brief also argues that the semi-auto rifle is in \u201ccommon use,\u201d not rare as some uninformed parties claim.<\/p>\n<p>\u201cThe principles established by <em>Heller<\/em> and confirmed by <em><u>Bruen<\/u><\/em> should make this a straightforward case,\u201d the brief states. \u201cThe paradigmatic semiautomatic rifle banned by Cook County is the modern AR-15, and not only is it \u2018commonly available,\u2019 but according to the agency charged with administering the Nation\u2019s firearms laws it is \u2018one of the most popular firearms in the United States.\u2019\u201d<\/p>\n<p>Also in the brief, FPC argues the banned rifles are \u201carms\u201d under the <em>Bevis<\/em> ruling, are useful for self-defense, are distinct from M16s and are protected under <em>Bevis<\/em>\u2019s historical analysis. It also argues that such rifles are not commonly used for unlawful purposes.<\/p>\n<p>\u201cWhile AR-15s and similar rifles are in common use for lawful purposes, there is one thing they very rarely are used for: violent crime,\u201d the brief states. \u201cFrom 2013 to 2022, rifles of any kind were used in an average of 356 homicides per year. Assuming every one of these rifles was a different AR-15 or similar semi-automatic rifle, that would mean that less than 0.01% of these rifles are used to commit homicide every year.\u201d<\/p>\n<p>Brandon Combs, FPC president, said the brief is part of the organization\u2019s extended fight against unconstitutional bans throughout the country.<\/p>\n<p>\u201cAs our brief makes clear, Cook County\u2019s authoritarian ban on protected arms is totally unconstitutional,\u201d Combs said in a press release announcing the brief\u2019s filing. \u201cWe will continue to fight forward until this ban and all others like it are eliminated.\u201d<\/p>\n<p>Plaintiffs in the case are Cutberto Viramontes, Rubi Joyal, Christopher Khaya, the Firearms Policy Coalition and the Second Amendment Foundation.<\/p>\n<div class=\"wp-next-post-navi\">\n<p>\nNext Post Coming Soon&#8230;\u25b6\n<\/p>\n<\/div>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.thetruthaboutguns.com\/fpc-files-brief-in-cook-county-illinois-awb-lawsuit\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Courtesy Wilson Combat Next Post Coming Soon&#8230;\u25b6 As the 7th Circuit Court of Appeals prepares to hear the case Viramontes v.
