We finally have an update for you on our lawsuit against the badly named Concealed Carry Improvement Act (CCIA) in New York!<\/span><\/p>\n This past Friday, GOA secured a partial\u2014yet significant\u2014victory in our legal fight to repeal the onerous concealed carry restrictions enacted by Gov. Kathy Hochul.<\/span><\/p>\n This battle is not yet over, as GOA plans to take this case all the way to the Supreme Court if necessary.<\/span><\/p>\n You can help support our efforts by making a contribution to our Litigation Fund, which will help us to continue challenging Hochul\u2019s anti-gun law in court<\/span><\/b><\/a>.<\/span><\/b><\/p>\n This fight has been a long, drawn-out battle that began in the summer of last year.<\/span><\/p>\n In July of 2022, despite the Supreme Court decision in the <\/span>Bruen<\/span><\/i> case stating that New York\u2019s draconian \u201cmay issue\u201d permitting system was unconstitutional, your State Legislators and Governor Kathy Hochul passed and signed into law the \u201cConcealed Carry Improvement Act,\u201d which does anything but improve your right to carry a concealed handgun.<\/span><\/p>\n The CCIA included:<\/span><\/p>\n GOA immediately promised to fight this and announced our lawsuit a short time later.<\/span><\/p>\n And in October of 2022, <\/span>GOA secured a Temporary Restraining Order on the CCIA<\/span><\/a>, and a month later, secured a <\/span>preliminary injunction<\/span><\/a>.<\/span><\/p>\n Finally, after many months of waiting and trying to keep your questions answered, we have a new update.<\/span><\/p>\n The U.S. Court of Appeals for the Second Circuit has affirmed a federal injunction against portions of New York\u2019s \u201cConcealed Carry Improvement Act.\u201d<\/span><\/a><\/p>\n The following provisions on New York\u2019s law are enjoined (struck down) under this ruling:<\/span><\/p>\n Frustratingly, the Second Circuit failed to faithfully apply <\/span>Bruen<\/span><\/i>, having left the \u201cgood moral character\u201d requirement in place for those seeking a concealed carry permit. Additionally, much of the court\u2019s opinion reads like a repudiation of <\/span>Bruen<\/span><\/i>, finding ways to claim its holdings don\u2019t apply here.<\/span><\/p>\n We have been getting a lot of questions about where you can and cannot carry in NY after this, so here is a list that will help guide you while exercising your Second Amendment rights.<\/span><\/p>\n\n
