Washington, D.C. \u2013 Today, the U.S. Court of Appeals for the Second Circuit\u00a0affirmed a\u00a0federal injunction\u00a0against portions\u00a0of New York\u2019s\u00a0poorly named \u201cConcealed Carry Improvement Act.\u201d This ruling follows several previous court actions on the case, including a\u00a0GOA and GOF secured\u00a0preliminary injunction<\/a>\u00a0from the Federal District Court in November 2022.<\/p>\n<\/div>\n The following provisions on New York\u2019s law are enjoined under this ruling:<\/p>\n<\/div>\n Frustratingly, the Second Circuit failed to faithfully apply\u00a0Bruen<\/em>, having left the \u201cgood moral character requirement\u201d in place for those seeking a concealed carry permit. Additionally, much of the Court\u2019s opinion reads like a\u00a0repudiation of\u00a0Bruen<\/em>, finding ways to claim its holdings don\u2019t apply here.<\/p>\n<\/div>\n Erich Pratt, GOA\u2019s Senior Vice President, issued the following statement:\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong><\/p>\n<\/div>\n \u201cGovernor Hochul and her cabal in Albany never seem to get the message, and in turn, GOA is proud to have played a major role in rebuking her unconstitutional law. Nevertheless, this was not a total victory, and we will continue the fight until this entire law is sent to the bowels of history where it belongs.\u201d\u00a0\u00a0<\/em><\/p>\n<\/div>\n Sam Paredes, on behalf of the Board of Directors for the Gun Owners Foundation, added:\u00a0\u00a0\u00a0\u00a0<\/strong><\/p>\n<\/div>\n \u201cIt\u2019s encouraging that the Court blocked the intrusive social media provisions, but just as intrusive are the processes needed to confirm someone is \u2018of good moral character,\u2019 which the Court has inexplicably chosen to uphold. Frustratingly, much of this Court\u2019s opinion reads like an insubordinate rebuke of the Supreme Court, which is a disgrace and cannot be allowed to stand.
