No, of course not. That\u2019s why yesterday\u2019s news of yet another Fifth Circuit Court of Appeals victory was just as sweet as <a href=\"https:\/\/www.thetruthaboutguns.com\/fifth-circuit-mandates-ruling-in-favor-of-plaintiff-in-cargill-v-garland-legalizing-bump-stocks-in-three-states\/\" target=\"_blank\" rel=\"noopener\">the others<\/a>. The latest judicial win was a ruling in <em><a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6573\/attachments\/original\/1699567052\/VanDerStok_v_Garland_208_Opinion.pdf?1699567052\" target=\"_blank\" rel=\"noopener\">VanDerStok v. Garland<\/a><\/em>, the case challenging the Biden ATF\u2019s frame or receiver rule that is a non-legislative re-definition of what constitutes a firearm.<\/p>\n<p>The <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/22\/22-60596-CR0.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> by a three-judge panel was unanimous (and glorious). Judge Kurt D. Engelhardt wrote . . .<\/p>\n<p style=\"padding-left: 40px;\"><em>It has long been said\u2014correctly\u2014that the law is the expression of legislative will. As such, the best evidence of the legislature\u2019s intent is the carefully chosen words placed purposefully into the text of a statute by our duly-elected representatives. Critically, then, law-making power\u2014the ability to transform policy into real-world obligations\u2014lies solely with the legislative branch. Where an executive agency engages in what is, for all intents and purposes, \u201claw-making,\u201d the legislature is deprived of its primary function under our Constitution, and our citizens are robbed of their right to fair representation in government. This is especially true when the executive rule-turned-law criminalizes conduct without the say of the people who are subject to its penalties. <\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The agency [ATF] rule at issue here flouts clear statutory text and exceeds the legislatively-imposed limits on agency authority in the name of public policy. Because Congress has neither authorized the expansion of firearm regulation nor permitted the criminalization of previously lawful conduct, the proposed rule constitutes unlawful agency action, in direct contravention of the legislature\u2019s will.<\/em><\/p>\n<p>Who could have guessed that? Then there was this gem from Judge Andrew S. Oldham . . .<\/p>\n<p style=\"padding-left: 40px;\"><em>The [ATF\u2019s] Final Rule is limitless. It purports to regulate any piece of metal or plastic that has been machined beyond its primordial state for fear that it might one day be turned into a gun, a gun frame, or a gun receiver. And it doesn\u2019t stop regulating the metal or plastic until it\u2019s melted back down to ooze. The [Gun Control Act] allows none of this. I concur in the majority\u2019s opinion holding the Final Rule is unlawful. Garland<\/a>. The Rule will remain in effect \u201cpending the disposition of the appeal in the United States Court of Appeals for the Fifth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought,\u201d per an August\u00a0<a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/23A82.html\">order<\/a>\u00a0from the Supreme Court. The opinion can be viewed at\u00a0<a href=\"http:\/\/fpclegal.org\/\">FPCLegal.org<\/a>.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cThe agency rule at issue here flouts clear statutory text and exceeds the legislatively-imposed limits on agency authority in the name of public policy,\u201d wrote Judge Kurt Engelhardt for the Court. \u201cBecause Congress has neither authorized the expansion of firearm regulation nor permitted the criminalization of previously lawful conduct, the proposed rule constitutes unlawful agency action, in direct contravention of the legislature\u2019s will.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201c[U]nless and until Congress [] acts to expand or alter the language of the Gun Control Act, ATF must operate within the statutory text\u2019s existing limits,\u201d the Court concludes. \u201cThe Final Rule impermissibly exceeds those limits, such that ATF has essentially rewritten the law. This it cannot do, especially where criminal liability can\u2014and, according to the Government\u2019s own assertions, will\u2014be broadly imposed without any Congressional input whatsoever.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201cThis is yet another massive victory against ATF and a huge blow to the Biden Administration\u2019s gun control agenda,\u201d said Cody J. Wisniewski, FPCAF\u2019s General Counsel and Vice President of Legal, and counsel for Plaintiffs. \u201cATF has no authority to make law, and the Biden Administration cannot circumvent Congress and the rights of the People through federal agency rulemakings\u2013a point the Fifth Circuit just reiterated.
