The Commerce Department\u2019s Bureau of Industry and Security posted a notice of a\u00a0<a href=\"https:\/\/www.bis.doc.gov\/index.php\/component\/docman\/?task=doc_download&amp;gid=3374\" target=\"_blank\" rel=\"noopener\"><strong>90-day \u201cpause\u201d<\/strong><\/a>\u00a0for the exports on a Friday afternoon \u2013 on the Frequently Asked Questions Section that\u2019s listed on the bottom the BIS website.<\/p>\n<p>The \u201cFriday news dump\u201d was apparently an attempt to slip the kneecapping of the industry under the radar. However, this appears to be a coordinated event and more evidence of gun control groups steering domestic and foreign policy for the Biden administration.<\/p>\n<h3><strong>Earlier Attacks<\/strong><\/h3>\n<p>President Biden\u2019s revulsion that Americans would actually choose to exercise their Second Amendment rights has long been clear. He labeled firearm manufacturers \u201c<a href=\"https:\/\/www.thetruthaboutguns.com\/?s=former+Vice+President+Joe+Biden+said+we+were+the+enemy\" target=\"_blank\" rel=\"noopener\"><strong>the enemy<\/strong><\/a>\u201d at the outset of his campaign for The White House. That was a purposeful choice of words. He didn\u2019t say the firearm industry \u201copposed\u201d his policies, nor did he say it was an \u201cadversary.\u201d He chose to call the firearm industry \u201cthe enemy,\u201d labeling it as an existential threat to the America he wanted to fashion during his administration.<\/p>\n<p>Since he was inaugurated, Biden has taken every opportunity to wage a campaign against the firearm industry and gun owners in general. He <a href=\"https:\/\/www.thetruthaboutguns.com\/unfit-to-serve-david-chipman-must-not-be-confirmed-as-atf-director\/\" target=\"_blank\" rel=\"noopener\"><strong>nominated David Chipman<\/strong><\/a>, a gun control lobbyist, to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The ATF, of course, is the federal agency that regulates the firearm industry. His nomination was akin to putting the fox in charge of the hen house.\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/president-biden-should-withdraw-chipman-nomination\/\" target=\"_blank\" rel=\"noopener\"><strong>NSSF opposed<\/strong><\/a>\u00a0and his nomination was withdrawn. Some of those cases were reopened to revoke licenses and shut down businesses and livelihoods. As part of that pressure campaign, there\u2019s been a significant increase in the number of \u201cvoluntary\u201d license surrenders by business owners who agreed to give up their licenses instead of fight the weight of the federal government over the onerous policy.<\/p>\n<p>President Biden has used nearly every lever of government he can to erect roadblocks to law-abiding citizens to exercise their Second Amendment rights and hobble the firearm industry\u2019s ability to meet the demands of gun owners. That\u2019s because they are. The Final Rules create criminal law without the consent and will of Congress. It is important to remember that only Congress can write laws \u2013 especially those that involve criminal punishments. When an executive authority does that on its own, that\u2019s tantamount to tyranny.<\/p>\n<p>President Biden also took aim at gun owners and hunters by kowtowing to anti-hunting and antigun special interests to ban the use of traditional lead ammunition on National Wildlife Refuges (NWRs). His administration hasn\u2019t done this\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/nssf-opposes-usfws-scientifically-unjustified-traditional-ammunition-ban\/?hilite=faustian\" target=\"_blank\" rel=\"noopener\"><strong>just once<\/strong><\/a>\u00a0\u2013 but\u00a0<strong><a href=\"https:\/\/www.nssf.org\/articles\/nssf-rejects-usfws-rule-banning-traditional-ammunition\/\" target=\"_blank\" rel=\"noopener\">twice<\/a><\/strong>\u00a0(and just last week). These rules phase out the use of traditional lead ammunition and require more expensive and less available alternative ammunition. There is no peer-reviewed, site-specific evidence to support the U.S. Fish and Wildlife Service (USFWS) claims. They published the rules claiming to protect human health, California <strong><a href=\"https:\/\/www.thetruthaboutguns.com\/media-reports-ignore-facts-in-their-anti-lead-ammunition-journalism\/\" target=\"_blank\" rel=\"noopener\">condors<\/a><\/strong> and American <strong><a href=\"https:\/\/www.thetruthaboutguns.com\/local-media-use-bald-eagles-to-push-a-false-anti-hunting-anti-gun-narrative\/\" target=\"_blank\" rel=\"noopener\">bald eagles<\/a><\/strong>. But the sites where they are banning the ammunition don\u2019t hold condor populations.<\/p>\n<p>The Centers for Disease Control and Prevention\u2019s own <a href=\"https:\/\/www3.nssf.org\/share\/factsheets\/PDF\/EatingGame_TradAmmo.pdf\" target=\"_blank\" rel=\"noopener\"><strong>research demonstrates<\/strong><\/a>\u00a0there is no human risk from consuming game harvested using traditional ammunition. American bald eagles are thriving, in large part because of the contributions paid by firearm and ammunition manufacturers through Pittman-Robertson excise taxes. That\u2019s benefited wildlife conservation to the tune of over\u00a0<strong><a href=\"https:\/\/www.nssf.org\/articles\/firearm-industry-surpasses-16-billion-in-pittman-robertson-excise-tax-contributions-for-conservation\/\" target=\"_blank\" rel=\"noopener\">$25 billion since 1937<\/a><\/strong>, when adjusted for inflation.<\/p>\n<h3><strong>The Latest Salvo<\/strong><\/h3>\n<p>Now, the Biden administration has slipped in this \u201cpause\u201d on firearm exports. That\u2019s significant for several reasons.<\/p>\n<p>First, President Biden campaigned on reversing the\u00a0<a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2021\/02\/NSSF-factsheet-USMLtoCCLTransition.pdf\" target=\"_blank\" rel=\"noopener\"><strong>U.S. Munitions List to Commerce Control List (USML-CCL) export reforms<\/strong><\/a>\u00a0that were begun under the Obama-Biden administration and completed by the Trump administration. Those reforms reduced regulatory costs and streamlined exports while strengthening end-to-end user checks to ensure firearm exports weren\u2019t being sent overseas to bad actors.<\/p>\n<p>Opponents of these reforms\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/antigun-senators-bloviate-over-inability-to-block-firearm-exports\/?hilite=senator+menendez\" target=\"_blank\" rel=\"noopener\"><strong>include disgraced U.S. Sen. The longtime ally of President Biden was recently indicted on federal corruption and bribery charges that stem from him greasing the skids for small-arms shipments to companies in Egypt. FBI officials raided his home and found hundreds of thousands of dollars wadded up and stuffed in his jacket pockets, along with stacks of gold bars. The twice-indicted senator has also been charged with illegally acting as an agent for the Egyptian government.<\/p>\n<p>The export \u201cpause\u201d is unprecedented and the timing is suspect. The Biden administration\u2019s <a href=\"https:\/\/www.thetruthaboutguns.com\/biden-asks-kamala-harris-to-do-for-gun-violence-prevention-what-shes-done-for-border-security\/\" target=\"_blank\" rel=\"noopener\"><strong>new Office of Gun Violence Prevention<\/strong><\/a>, which is\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/lets-take-a-look-at-who-will-be-running-bidens-new-ministry-of-gun-control\/\" target=\"_blank\" rel=\"noopener\"><strong>staffed by gun control lobbyists and<\/strong>\u00a0<strong>activists<\/strong><\/a>, just concluded a roundtable meeting with Democratic lieutenant governors to explore new ways they could collaborate on more gun control.<\/p>\n<p>It also took place in the wake of <a href=\"https:\/\/www.bloomberg.com\/news\/storythreads\/2023-08-09\/how-the-us-exports-more-semiautomatic-weapons-and-gun-culture\" target=\"_blank\" rel=\"noopener\"><strong>successive<\/strong>\u00a0<strong>Bloomberg News features<\/strong><\/a> that called into question exports to foreign countries, falsely alleging that U.S. manufacturers are somehow complicit in stoking crime.<\/p>\n<p>One was an attack on SIG SAUER over crime in Thailand and a later article focused on Central and South America. Another attacked the Commerce Department\u2019s role in assisting U.S. manufacturers at NSSF\u2019s annual SHOT Show. That\u2019s something the Commerce Department does for <em>all<\/em> industries.<\/p>\n<p>Bloomberg News is owned, of course, by Michael Bloomberg. He\u2019s the billionaire former New York City mayor who\u00a0<strong><a href=\"https:\/\/www.thetruthaboutguns.com\/after-blowing-1-billion-on-his-campaign-bloombergs-throwing-money-into-making-texas-blue\/\" target=\"_blank\" rel=\"noopener\">flamed out<\/a><\/strong> on his own attempt to occupy the Oval Office. He also ran an undercover sting to uncover illegal gun trafficking in other states\u2026without notifying the ATF or FBI. When you pay that much money to fund gun control, universities name an entire school after you.<\/p>\n<p>During this so-called \u201cpause\u201d in exports, the Commerce Department will conduct a \u201cpolicy review to determine if changes are warranted to advance U.S. national security and policy interests.\u201d Of course, this raises concerns that under the guise of human rights, the Biden administration will actually attempt to undo the USML-CCL reforms, extend the \u201cpause\u201d indefinitely, impose unwarranted regulatory burdens to increase costs to exporters and close off overseas markets to American firearm manufacturers.<\/p>\n<h3><strong>Purely Political<\/strong><\/h3>\n<p>All firearm and ammunition exports, of course, are subject to Defense and State Department review, which can halt exports if there are concerns. Firearm and ammunition license applications undergo a 100 percent end-user check by the <strong><a href=\"https:\/\/www.bis.doc.gov\/index.php\/enforcement\" target=\"_blank\" rel=\"noopener\">BIS Office of Export Enforcement<\/a>. <\/strong>They do this regardless of how long a company has been doing business with a particular customer, regardless of how many times the buyer was subjected to an end-user check and regardless of whether BIS has no derogatory information on that customer, even if the end-user was recently approved.<\/p>\n<p>At present, <em>no other commodity<\/em> is subject to this same 100 percent check requirement. The kicker is that The White House has complete authority to regulate the export of firearms. That\u2019s what exposes this \u201cpause\u201d as being purely politically motivated.<\/p>\n<p>In July, the Biden administration sought to create a new division within BIS called \u201cEmbargoes and Human Rights.\u201d With the assistance of the U.S. House of Representatives Committee on Commerce, Justice and Science, this creation of the division was blocked. It could be that the export \u201cpause\u201d is political payback.<\/p>\n<p>There\u2019s no right to export and the decision to grant or deny a license is purely a function of the national security and foreign policy assessment of those in charge. The USML-CCL reforms give the administration <strong><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/50\/4811\" target=\"_blank\" rel=\"noopener\">complete and essential unfettered discretion<\/a><\/strong>. BIS invoked national security and foreign affairs as the reason for the pause.<\/p>\n<p>Congressional reaction to this move comes through the power of the purse. It\u2019s also a shameless favor to the gun control industry that have bought their way into The White House and are now using foreign policy to exert their influence over domestic policy.<\/p>\n<p>The American firearm industry has been called the \u201c<strong><a href=\"https:\/\/detroithistorical.org\/learn\/encyclopedia-of-detroit\/arsenal-democracy\" target=\"_blank\" rel=\"noopener\">arsenal of democracy<\/a><\/strong>\u201d because a strong and robust small arms manufacturing base has armed and equipped our law enforcement at home and our military and allies abroad.
