If they\u2019re not <a href=\"https:\/\/www.thetruthaboutguns.com\/knock-knock-video-shows-atf-straw-purchase-task-force-asking-to-see-delaware-homeowners-guns\/\">running down legitimate gun owners<\/a> while fishing for straw purchasers, then they\u2019re trying to intimidate people into surrendering <a href=\"https:\/\/www.thetruthaboutguns.com\/atf-issues-letter-to-ffls-classifying-some-forced-reset-triggers-as-machineguns\/\">forced reset triggers<\/a>. Now they\u2019re hitting the pavement hectoring people about (formerly legal) solvent traps.<\/p>\n<p>The fine folks over at Gun Owners of America have come across video from an ATF home visit documenting a couple of he Justice Department\u2019s finest trying to get a gun owner to admit to owning or receiving a now-prohibited solvent trap. They also wanted him to surrender it.<\/p>\n<p>On this day at this address, ATF-Troop ran into a gun owner who not only refused to admit to anything, but he told them to beat it and come back with a warrant. He also videotaped the encounter. Ouch.<\/p>\n<p>ATF-Troop didn\u2019t like his assertion of his rights.<\/p>\n<p style=\"padding-left: 40px;\"><em>Agent #2:\u00a0 \u201cWe\u2019re not trying to be jerks here.\u201d\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cYou are though\u2026\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Agent #2:\u00a0 \u201cBut we\u2019re not.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cYou\u2019re the ATF.\u201d<\/em><\/p>\n<p>The man then told them that their job is to take away people\u2019s guns.\u00a0 To which, Agent #2 says, \u201cI don\u2019t think you have any idea what our job is.\u201d<\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cI know everything about your job. All it is, is to erode the 2nd Amendment.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Agent:\u00a0 \u201cPlease tell me\u2026\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cShall not be infringed.\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Agent:\u00a0 \u201cSo, uh, violent, uh, criminals with guns that we take off the street \u2013 \u201c<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cOh, like at Waco?\u201d<\/em><\/p>\n<p>Ouch that one\u2019s gonna leave a mark. But the man wasn\u2019t done yet.<\/p>\n<p style=\"padding-left: 40px;\"><em>Man:\u00a0 \u201cOr at Ruby Ridge?\u201d<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Agent:\u00a0 \u201cOh gosh.\u201d<\/em><\/p>\n<p>At this point, the agents dialed the snark up to 11, but eventually left empty-handed after making assorted veiled threats toward both the man <em>and<\/em> his dogs.<\/p>\n<p>Here\u2019s the video from Gun Owners of America.<\/p>\n<p><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><noscript><\/p>\n<div class=\"youtube-embed\" data-video_id=\"JJpa6D7OnDs\"><iframe loading=\"lazy\" title=\"\u201cGET A WARRANT\u201d - ATF Attempts Solvent Trap Confiscation\" width=\"696\" height=\"392\" src=\"https:\/\/www.youtube.com\/embed\/JJpa6D7OnDs?feature=oembed&#038;enablejsapi=1\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/div>\n<p><\/noscript><\/span><\/p>\n<p>For how to handle any law enforcement officer knocking at your door, more Americans would do well to introduce themselves to John H. Bryan (otherwise know as the Civil Rights Lawyer) and his article, <a href=\"https:\/\/thecivilrightslawyer.com\/2022\/08\/08\/cops-at-your-door-what-they-dont-want-you-to-know\/\"><em>Cops at your door?\u00a0 What they don\u2019t want you to know<\/em><\/a> . . .<\/p>\n<p style=\"padding-left: 40px;\"><em>\u2026If police officers are on your private property, that changes things. Cops are trained on the requirement for reasonable suspicion \u2013 to develop some reasonable suspicion they can articulate, even if total B.S., and then that entitles them to forcibly demand identification from whomever they deem a suspect. That is generally how things work in public places \u2013 but not on private property, especially a home.\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Let\u2019s look at this scenario of police on your front porch and make sure we\u2019re all on the same page about what the law is, and what the law is not, for both police and the occupants of private property.\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>According to the 1980 Supreme Court opinion in\u00a0<strong>Payton v. New York<\/strong>, in order to legally arrest someone in a home, rather than in a public place, absent consent or exigent circumstances, police officers must have a warrant.\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>According to the 1984 Supreme Court opinion in\u00a0<strong>Oliver v. United States<\/strong>, the heightened Fourth Amendment protections of the home extend beyond just the interior of the home itself into what\u2019s called the \u201ccurtilage\u201d of the home, which is the land immediately surrounding and associated with the home. Why? Because according to the Supreme Court, the curtilage is considered part of the home itself for Fourth Amendment purposes. The Fourth Circuit, where the porch video occurred, just in 2015 issued an opinion holding that a warrantless search of curtilage is presumed to be unreasonable. (Covey v. Assessor of Ohio County).<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>In the 2013 Supreme Court opinion of\u00a0<strong>Florida v. Jardines<\/strong>, the Court held that a search undoubtedly occurs when the government, without a warrant, obtains information by physically intruding within the curtilage of a house, which in that actual case involved a home\u2019s front porch. The Court cautioned that a search occurs unless a homeowner has explicitly or implicitly sanctioned the government\u2019s physical intrusion into the constitutionally protected area, i.e., the yard and\/or porch of the home.<\/em><\/p>\n<p>So if the ATF shows up at your door, your best bet is probably to shut up. Say less, in fact, than the man in the video above did.
